What degree is my shoplifting charge?
Second degree if full retail value is $75,000 or more
Third degree if full retail value is at least $500 but less than $75,000
Fourth degree if full retail value is at least $200 but not more than $500
*If full retail value is less than $200, it is a disorderly persons offense and will be handled in Municipal Court.

What are penalties for shoplifting in New Jersey?
Second Degree: 5-10 years in prison, fine up to $150,000
Third Degree: 3-5 years in prison, fine up to $15,000
Fourth Degree: up to 18 months in prison, fine up to $10,000
Third Degree: 3-5 years in prison, fine up to $15,000
Fourth Degree: up to 18 months in prison, fine up to $10,000
Mandatory community service
If first offense: at least 10 days community service
If second offense: at least 15 days community service
If third or more offense: maximum of 25 days and minimum jail term of 90 days
