Types of violations in municipal court

- Motor Vehicle Offenses: DWI, DUI, leaving the scene of an accident, driving while suspended, failure to report an accident, driving without insurance, no registration.
- Minor Criminal Offenses called Disorderly/Petty Disorderly Persons Offenses: marijuana, drug possession in a motor vehicle, simple assault, domestic violence, shoplifting, bad checks, theft.
- Ordinances: underage drinking, noise violation, public nuisance, building code violations, dog barking.

What are my rights in municipal court in New Jersey

I can't afford an attorney
If you do not think you can afford a private attorney to defend you in court, you have the right to apply for the Public Defender. You will need to fill out an application at the court house concerning your financial situation. A judge will review it and determine if you are eligible.
Below is a sample of the Income Eligibility Guidelines used to appoint a Public Defender in 2019.
*Annual gross income for a household of one: $15,612.50
*Annual gross income for a household of two: $21,137.50
*Annual gross income for a household of three: $26,662.50

Statue Of Limitations For Disorderly/Petty Disorderly Persons
A disorderly persons offense or petty disorderly persons offense must be commenced within one year of the offense being committed pursuant to NJSA 2C:1-6(b)(2).
