Am I eligible for a clean slate expungement in NJ?
Per the June 2020 expungement law amendments, a person who is not eligible for an expungement under any other section of the law, may present a petition under this section if the person has been convicted of one or more crimes, one or more disorderly persons/petty disorderly persons offenses, or a combination of crime and offenses, unless the person has a conviction for a crime not subject to expungement.
When can I file an expungement petition?
Per the June 2020 expungement law amendments, you can apply for a clean slate expungement after 10 years of your most recent conviction, payment of fine, satisfactory completion of probation, parole or release from jail, whichever date is later.
What if my fines are unpaid?
If your fines are still due because of reasons other than your willful noncompliance, but the time requirement of 10 years is otherwise satisfied, a court can grant the expungement and issue a civil judgment for the unpaid amount of fines.
