Arson Lawyer

ARSON NJSA 2C:17-1

Being charged with Arson or any of its related offenses in New Jersey is very serious.  You already know that, which is why you are searching for an arson lawyer.  What you do not know is that the Judge and Prosecutor treat these cases with elevated concern because of the risk of people being injured and the risk of someone starting another fire.

Burning down a building or house or starting a fire is never the answer.  We have defended individuals charged with Arson who were INNOCENT.  We have also represented those that were guilty.  No matter what you situation is, WE CAN HELP YOU.

Guilty of arson if:

Purposely starts a fire or causes an explosion that:
  1. Recklessly places another person in danger of death or bodily injury; or
  2. Recklessly places a building or structure of another in danger of damage or destruction; or
  3. With purpose of collecting insurance for destruction or damage to such property; or
  4. With purpose of destroying or damaging a structure in order to exempt the structure from any State, County or local zoning, planning or building law, regulation, ordinance or enactment; or
  5. Recklessly places a forest in danger of damage or destruction

What degree is my arson charge?

Arson, NJSA 2C:17-1(b), is a crime of the third degree.  However, if you were charged with Aggravated Arson, NJSA 2C:17-1(a), that is a crime of the second degree.  It can also be a crime of the fourth degree (NJSA 2C:17-1(c)) if you failed to control or report a dangerous fire.

What are penalties for arson in New Jersey

Second Degree: 5-10 years in prison, fine up to $150,000

Third Degree: 3-5 years in prison, fine up to $15,000

Fourth Degree: up to 18 months in prison, fine up to $10,000
