Guilty of arson if:
Purposely starts a fire or causes an explosion that:
- Recklessly places another person in danger of death or bodily injury; or
- Recklessly places a building or structure of another in danger of damage or destruction; or
- With purpose of collecting insurance for destruction or damage to such property; or
- With purpose of destroying or damaging a structure in order to exempt the structure from any State, County or local zoning, planning or building law, regulation, ordinance or enactment; or
- Recklessly places a forest in danger of damage or destruction
What degree is my arson charge?
Arson, NJSA 2C:17-1(b), is a crime of the third degree. However, if you were charged with Aggravated Arson, NJSA 2C:17-1(a), that is a crime of the second degree. It can also be a crime of the fourth degree (NJSA 2C:17-1(c)) if you failed to control or report a dangerous fire.
